Terms of service agreement

Agreement of terms

FundingCubes (hereafter referred to as the "Company," "we," "us," and/or "our"), provides its services to you subject to the subsequent Terms of Service. We may update these Terms of Services from time to time without any notice to you. You must check these Terms regularly for any changes. By using our services, you admit to bound by the following Terms, our Privacy Policy, and all relevant laws and conditions or policies referenced here.

 

When using the services of FundingCubes, you shall be accountable for any guidelines or rules relevant that may be posted on the website ("our website") from time to time. For other's consent, actions, or inactions, you will not hold the Company answerable. You agree that we have zero control over and do not assure the quality, security, or legality of companies promoted, the truth or exactness of content, listings, or expertise to achieve the stated objective.

 

Description and definitions of the Service

The Service is a simple, easy-to-use application that can quickly be promoted through social media services, websites, and email.

 

Campaign- Campaign is any fundraising project created using our Service. It can be made either to collect money for personal reasons or on behalf of an organization.

 

Campaign owner- The campaign owner is the person that created the Campaign. The campaign owner has complete access to features and tools for the Campaign created by him/her, including but not limited to tracking contributions and editing details of their Campaign.

 

The campaign owner may also grant access to the Campaign's features and tools to users, and they are subject to these Terms as consented to by the fundraiser (campaign owner). If the campaign owner decides to transfer or share ownership of there with another user anytime, that user will become a campaign owner. They will assume the access mentioned above and responsibilities.

 

Contributor- Contributor is any individual/organization that contributes money to a campaign.

 

Contribution- Contribution is any financial transaction that benefits the Campaign.

 

Organization- Organization could be a nonprofit, school, political entity, business, or other social entity that has a collective goal.

 

User- User is any individual who has agreed to the Terms by logging in to the Service via Login Service or by contributing to a Campaign.

 

Payment provider- Payment provider is a company that processes contributions to campaigns.

 

Eligibility

If you are below 18 years of age, you cannot use the Service without approval. Assume you are between 13-17 years of age. In that case, you are allowed to use the services with the permission and supervision of your parent or legal guardian - aged at least 18 years old, and also that your parent or legal guardian consents to be bound by these Terms and agrees to be responsible for your use of the Service. If you have been previously suspended from using the Service for any reason, you are not eligible to use the Service. We hold the freedom to reserve the right to refuse the Service's use to anyone and to decline, discontinue, interrupt, remove or suspend a Fundraising Campaign at any time for any reason without liability.

 

Payment processing information

The Company is not linked with any payment Payment processor. Neither is the representative or employee of the other and is also not liable in any way for the actions/performance of the other. The same goes for Company as well as users, on the other hand. The services rendered by the Company may be in partnership with any other service provider.

 

Therefore the user uses these services in conjunction with the services of another service provider, and the user will be subject to the other service provider's terms of Service. Further, neither the Company nor the other service provider will be considered the other's agent or employee. Neither will be liable in any way for the activities or performance (or lack thereof) of the other.

 

Third-party service providers may be involved to do the following:

  • Generate and send tax receipts for donations to nonprofit organizations
  • Third-party service providers may charge a fee for their services.

 

In case of any refund, the campaign owner accepts the responsibility to provide refunds to contributors and that the Company will not be held liable for refunds. The users agree to the Payment Provider withholding a Service fee and making these fees available to the Company by using the services.

 

Fees

All campaigns are free to create on our site. However, we will be deducting the flat fee of 4.95% to process the payments for the fundraisers..

 

If you are contributing or donating to any campaign, there is no requirement to pay a fee. However, contributors have the option to pay fees on the transaction on behalf of the Recipient if they wish to. There are no additional fees or penalties.

 

Refund policy

All contributors must request any refund directly from the campaign owner. On the other hand, the campaign owner must process the refund to the contributor through the Payment Provider within seven days from getting the Contribution that is being refunded, then contact the Company to demand a fee cancellation.

 

Further service agreements

Any new features that expand or intensify the Service shall be subject to the Terms, unless explicitly stated otherwise. You acknowledge that the Service is provided AS-IS and that the Company has no liability for the timeliness, deletion, or negligence to store any information or personalization settings.

 

Contributors

As a contributor, before you make any contributions, you are solely responsible for asking any questions or investigating campaigns to the extent you feel is necessary. All donations made by the contributor are made voluntarily and at your sole discretion and risk. The Company does not assure that contributions made will be used as declared that Campaign Creators will deliver Incentives or that their launched Campaign will accomplish its goals. The Company also does not endorse, validate, make representations, or provide warranties for or about the quality, protection, honesty, or legitimacy of any Campaign, Incentive, or Contribution, or the truth or accuracy of content posted on the Campaign. If you are issued a refund on your Contribution, you will no longer be entitled to deliver any Incentives associated with your Contribution.

 

Taxes

The campaign owner is entirely responsible for understanding that the Service's funds can be classified as taxable income to the Campaign Owner. The campaign owner must also determine how to treat, collect, and address any taxes on  Contributions in connection with your Incentives.

 

Organizing Campaign on behalf of others

Organizations

The Campaign Owner must present the Company and Payment Provider with proof that the Organization has sanctioned the Campaign Owner to work on its behalf. The Campaign Owner must also provide an email to the Payment Provider and provide the Company with a Letter of Subordination on letterhead from the Organization approved by an authorized officer of that Organization that grants the Campaign Creator the right to fundraise on behalf of the Organization.

 

Individuals

Campaign Owner must provide the Company with information and/or documentation proving that Campaign Owner has the authority to raise funds on behalf of the individual and that the funds will be transferred to that individual.

 

Restricted activities

Campaign owners are forbidden from:

  • Activities that disrupt the Payment Provider's Acceptable Use Policies, Facebook's Statement of Rights and Responsibilities, Google's Terms of Service.
  • Any act that violates national, regional, and local laws related to online commerce.
  • Campaign Owners are not allowed to run lotteries, gambling activities, or any other form of prohibited financial activity using the Service.
  • Campaign Owners cannot support hate, violence, harassment, bullying, or intolerance to race, national origin, sex, gender, or diseases.

 

Set up obligations

Campaign owners agree to;

  • Provide true, current, and full information about themselves and the Organization they are raising funds for.
  • Maintain and update the Set Up Data. If any provided information is untrue or the Company suspects any information to be inaccurate, the Company has the right to suspend/terminate your use of the Service.

 

Security and agreement

We provide access to the Service through Facebook Login, LinkedIn Sign-in, Google Sign-In, and email. You are solely responsible for maintaining the Login Services' confidentiality and activities in your Login Service account. You also agree to immediately notify the Company of any unauthorized use of your Login Service account.

 

Conduct

Using the Service, you agree that you are liable for all information, products/services that you provide to other users. You agree not to use these Services to upload, post, email, send or make available any information, products or services, that are illegal, harmful, and threatening.

 

No release of Service

You admit not to reproduce, copy, sell, exploit, or duplicate any portion of our Services for any commercial use. You also agree not to access the Service other than the Service provided within the Service's scope.

 

Changes of Service

The Company has the freedom to change, discontinue (temporarily or permanently) the Service with/without any notice at any given time. The Company is not liable to you for refunding the Service fees for any reason. The Company is not answerable for any third-party for any changes, suspension, or discontinuance of the Service.

 

Termination

You agree that the Company may terminate the Service's use, remove, and discard any information within the Service and It can be done for any reason. The Company also has the right to discrete or discontinue any Service or part of the Service with/without notice. The Company is not liable to you and any third-party for any termination of your access to Service.

 

Links to resources

The Company and the third-parties may provide links to World Wide Web sites or resources as the Company has no authority above such sites and resources. You agree that the Company is not responsible for any content, ads, products, or other materials on or available from such sites and resources. The Company is also not liable directly/indirectly for any damage, loss, or alleged to be caused by/in connection with the usage of any such content.

 

 

Publishing and communications

Campaign Owners, by creating their Campaign and Contributors by contributing to these Campaigns, agree to their Campaign images, videos, text, or excerpts used for discovery in our Service Find pages and search engine results. They also agree to their appearance in Service-related communications or promotions or news articles or reports issued on news media websites or print publications.

 

The Company's proprietary rights

You agree that the Service and necessary Software used in connection with the Service incorporates exclusive and confidential data, preserved by relevant intellectual property and different laws. You also agree that any information provided to you via Service is guarded by copyrights, trademarks, service marks, patents, or another proprietary licenses and laws.

 

Disclaimer of warrants

You acknowledge that you use the Service at your own risk and that the Company makes no warranty that:

  • The Service will meet your requirement
  • The Service will be secure, fault-free, or uninterrupted
  • The quality of the Service will meet your expectations
  • The result obtained from the Service will be accurate or reliable

 

Limitation of liability

You agree that the Company is not liable for any direct/indirect, incidental, special, or exemplary damages that may result from:

  • Use of the Service
  • Unauthorized access
  • Conduct of any third-party on the Service
  • Or any other matter is associating with the Service

 

Exclusions and limitations

Some provinces do not exclude certain warranties/limitations/exclusion of liability for incidental or consequential damages. Some of the conditions of the Terms section may not apply to you. If the Company is found to be liable, our liability to you and third-party is limited to

  • Total service fee you paid to us in 12 months before action
  • $100

 

 

Release

In case you have any dispute with users/users, you release us from any claim, demands, or damages, arising out of the conflict.

 

Notice

Any notice by the Company may be made through email. The Company can also provide notices of changes to the Terms or other matters by displaying notices/links on the Service. Our mailing address is help@fundingcubes.com.

 

Trademark information

FundingCubes, trademarks and service marks, and other Company logos and product and service names are owned by and/or trademarks of FundingCubes. You agree not to practice or display the FundingCubes Marks.

 

Violations

In case of any violations of the Terms of Service, please report to help@fundingcubes.com. Any accusations of illegal Campaign activities can only be responded to if communicated through formatted requests from law enforcement organizations.
